These Terms of Service (the “Terms”) are a binding agreement between you and Church Registry, Inc. (“Church Registry,” “we,” “us,” or “our”) and govern your access to and use of the Church Registry websites, applications, and services (together, the “Service”). If you are using the Service on behalf of a church or organization, you represent that you are authorized to accept these Terms for that organization.
1 Customers, administrators & authorized users
The Service is used by different kinds of people, and these Terms apply to all of them:
- Customer. The church or organization that opens an account and is responsible for it, including for payment and for the people it invites.
- Administrators. The individuals a Customer designates to manage its account, configure settings, and control who has access.
- Authorized users. Staff, volunteers, and other people a Customer or its administrators invite to use the account.
- Individuals. Members, guests, donors, and others whose information a Customer stores in the Service. Individuals interact with the Customer, not directly with us, and the Customer controls their information.
Each Customer is responsible for the activity that happens within its account and for ensuring its administrators and authorized users follow these Terms.
2 Responsibilities of users
When you use the Service, you agree to:
- Provide accurate account information and keep it current.
- Keep your login credentials confidential and not share your account.
- Be responsible for all activity that occurs under your login.
- Use the information of members and individuals lawfully, and only for legitimate ministry and administrative purposes.
- Obtain any consents your church is required to obtain from the people whose information it stores, including for messaging.
- Notify us promptly if you believe your account has been accessed without authorization.
You are responsible for the content you upload and for making sure you have the right to store and use it.
3 Requirements for use
To use the Service, you must be at least 18 years old (or the age of majority where you live) and able to enter into a binding contract. The Service is intended for use by churches and organizations and the adults who run them. You may not use the Service if we have previously suspended or removed your access, or if doing so would violate any applicable law.
Some features may have additional requirements, which we will make clear when you use them.
4 Acceptable use
You agree not to use the Service to:
- Break the law or infringe anyone’s rights, including privacy and intellectual property rights.
- Upload malicious code, attempt to gain unauthorized access to the Service or other accounts, or interfere with the Service’s operation or security.
- Send spam or unlawful, harassing, deceptive, or abusive messages.
- Store or share content that is unlawful, harmful, or that you do not have the right to share.
- Resell, rent, or sublicense the Service without our written permission, or use it to build a competing product.
- Misuse another organization’s or individual’s data.
We may investigate suspected violations and may suspend or remove content or access to protect the Service and its users.
5 Service provider status
For most of the data in the Service, the Customer is in control and we act on its behalf. Under data protection laws, this generally means the Customer is the “controller” (or “business”) and we are the “processor” (or “service provider”). We handle that information to provide the Service and according to the Customer’s instructions and our Privacy Policy. Questions about how a particular church uses your information should be directed to that church.
6 Monitoring & security
We take reasonable measures to protect the Service and the information it holds, including encryption in transit, access controls, and routine safeguards. No online service can be perfectly secure, so we cannot guarantee absolute security, but we work to protect your data and to keep the Service reliable.
We may monitor use of the Service to maintain its security, integrity, and performance, and to enforce these Terms. We do not routinely access the contents of a Customer’s account except as needed to operate the Service, provide support you request, or comply with the law.
7 Billing & payment
Church Registry is offered as a single plan billed at a flat annual price, with every feature included. The current price is shown on our pricing page.
How you can pay
You can pay by credit or debit card, or by mailed check.
- Card. Card payments are processed by our third-party payment providers, Stripe and Authorize.net. Authorize.net handles and stores cardholder information, including names and card details, in order to process payments. We do not store full card numbers ourselves. Your use of card payment is also subject to those providers’ terms and privacy policies.
- Check. If you choose to pay by check, we will provide payment details and activate your account once we receive and process your payment. Because mailed payments can take time to arrive and clear, your account remains in a pending state until then.
Renewals, taxes, and failed payments
Annual subscriptions renew for another year unless you cancel before the renewal date. We will collect sales tax where we are required to do so. If a card payment fails or a check cannot be processed, we may suspend access until payment is resolved. Donations and other payments that churches collect from their members through the Service are between the church and its members; we are not responsible for those transactions, and any disputes about them should be resolved with the church.
8 Cancellation & termination
You may cancel your account at any time. Because plans are billed annually in advance, cancellation stops future renewals; we do not provide prorated refunds for the remainder of a paid term unless required by law or stated otherwise in writing. We may suspend or terminate an account that violates these Terms, that poses a security or legal risk, or for non-payment. If we terminate an account without cause, we will make a reasonable effort to give you notice and an opportunity to export your data.
9 Changes to the service & pricing
We may add, change, or remove features to improve the Service. We may also change pricing; if we change the price of your plan, we will give you advance notice before it takes effect, and the change will apply at your next renewal. If we make a material change to these Terms, we will post the updated Terms and update the date at the top of this page, and where appropriate we will notify you. Continuing to use the Service after changes take effect means you accept the updated Terms.
10 Messaging & chat features
The Service includes features for churches to communicate with their people, such as email and text broadcasts and team chat.
- Consent. If your church sends text messages or other communications to its members through the Service, your church is responsible for obtaining the consents required by law and for honoring opt-out requests.
- Opting out and help. Recipients can opt out of text messages using standard replies (such as STOP) or by contacting the church. Opt-out and consent information is used only to deliver and manage those messages and is not shared for unrelated purposes.
- Acceptable content. Messaging features may not be used to send spam or unlawful, harassing, or deceptive content.
Some messaging features may rely on third-party providers, and your use of them is also subject to those providers’ requirements.
11 Intellectual property, content ownership & third-party services
Our property. The Service, including its software, design, and branding, belongs to Church Registry and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service while these Terms are in effect. You may not copy, modify, reverse-engineer, or create derivative works from the Service except as the law allows.
Your content. The information and content you put into the Service remains yours. You grant us the limited rights needed to host, process, and display that content in order to provide the Service to you. We do not sell or rent your content, and we do not use it to market to your members.
Third-party services. The Service may connect to third-party tools and integrations that you choose to enable. Those services are controlled by others and have their own terms and privacy practices. We are not responsible for third-party services, and your use of them is at your own discretion.
12 AI features
If we offer features that use artificial intelligence, we will use them to help you work more efficiently, not to repurpose your church’s data for unrelated commercial ends. We do not sell your data, and we do not use the personal information in your account to train third-party AI models for their own purposes. Where an AI feature relies on a third-party provider, we will choose providers that handle data responsibly, and any such processing remains subject to our Privacy Policy. AI output can be imperfect, so you should review it before relying on it.
13 Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Church Registry and its officers, employees, and agents from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of any law or third-party right.
14 Disclaimers & warranties
Disclaimer. The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
Limitation of liability. To the fullest extent permitted by law, Church Registry will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
15 Email & communications with us
By using the Service, you agree that we may send you electronic communications about your account, including service, security, and billing notices. We may also send occasional product updates; you can opt out of non-essential marketing messages at any time using the unsubscribe link or by contacting us. If you share feedback or suggestions about improving the Service, you grant us the right to use that feedback without obligation to you.
16 Arbitration, jury trial waiver & class action waiver
Binding arbitration. Except as described below, you and Church Registry agree to resolve any dispute arising out of or relating to these Terms or the Service through final and binding arbitration, rather than in court. The arbitration will be administered by a recognized arbitration provider under its applicable rules, and judgment on the award may be entered in any court with jurisdiction.
Jury trial waiver. You and Church Registry waive any right to a trial by jury for disputes covered by this section.
Class action waiver. Disputes will be resolved only on an individual basis. You and Church Registry agree not to bring or participate in any class, collective, or representative action regarding disputes covered by this section.
Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court to protect its intellectual property or stop unauthorized use of the Service.
Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice to public@churchregistry.com with your name, account, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other part of these Terms.
This section is governed by the Federal Arbitration Act to the extent applicable.
17 Miscellaneous
Governing law. These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs the arbitration section. Subject to the arbitration section, any disputes that proceed in court will be brought in the state or federal courts located in Nevada.
Entire agreement. These Terms, together with our Privacy Policy and any plan-specific terms, are the entire agreement between you and Church Registry about the Service.
Severability. If any provision is found unenforceable, the rest of the Terms remain in effect.
No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
Force majeure. Neither party is liable for delays or failures caused by events beyond its reasonable control.
